Regulations on Penalties for Discipline Breach

The regulations are stipulated for the purpose of strengthening the construction of the spirit and disciplines of the university, maintaining a fine order for teaching and daily life and developing a good study and living atmosphere on the basis of Regulations on Students’ Administration in Institutions of Higher Education and Regulations on Enrolling International Students in Institutions of Higher Education issued by the Ministry of Education and the practical situations of the university. 

Article 1 The regulations apply to all the international students enrolled in NUIST. 

Article 2 Penalties for the international students that violate the regulations shall be fair in procedure, sufficient in evidence, clear in argument, accurate in nature determination and proper in punishment.

Article 3 Categories of disciplinary penalties:

1. Warning;

2. Serious warning;

3. Demerit;

4. Probation;

5. Expulsion.

Article 4 International students can get lighter or mitigated penalties in any of the following situations: 

1.Voluntarily confess the offenses, deeply understand the mistakes and perform outstandingly in repentance;

2. Voluntarily expose the offenses of others which are verified later.

Article 5 International students can get more severe penalties in any of the following situations:

1. Refuse to confess mistakes after offenses; commit perjury and hinder the investigation; make excuses, show bad attitudes and badger irrationally; 

2. Threaten or take revenge on offense reporters, witnesses or administrators;

3. Have been punished during the study in the university.

Article 6 International students will be expelled from the university if they violate Chinese laws and are involved in crimes. International students will be expelled from the university if they commit acts of a vile nature that violate the administration regulations of public security. International students will be given demerits or probations according to the seriousness of other violations of the administration regulations of public security.

Article 7 International students will be expelled from the university if they organize or incite the disturbance, undermine the stability and unity of the society, and disturb the order of social life. International students will be expelled from the university if they establish illegal organizations or plan and organize assembly, parades and demonstrations without permission of relevant departments. International students will be educated or warned if they take part in the illegal organizations, assembly, parades or demonstrations according to the seriousness of the cases.

Article 8 International students will be given the following penalties according to the seriousness of the cases and consequences if they violate the regulations of the university, thus disturbing the order of teaching, daily life and public administration and infringing on the legitimate rights and interests of other individuals and organizations, but the case is not serious enough to constitute a crime:

1. International students will be given warnings, serious warnings or demerits if they violate the regulations of the university, thus disturbing the order of teaching, daily life and public management, infringing on the legitimate rights and interests of other individuals and organizations. International students will be given probations or expulsion from the university if the cases and consequences are serious enough;

2. International students will be given penalties ranging from warning to probation if they impede the implementation of the official duties by state functionaries or NUIST administrators in accordance with Chinese laws or the university regulations in the light of the seriousness of the cases and consequences;

3. International students will be given serious warnings or demerits in addition to making economic compensations, if they intentionally destroy public facilities and properties of other individuals or the university and illegally use electricity, fire or other dangerous stuff;

4. International students will be given serious warnings or demerits if they commit knaveries such as sexual harassment, get drunk and make trouble, gamble or provide conditions for gambling;

5. International students will be given serious warnings or demerits if they circulate and duplicate illegal books or audio-visual products, take part in illegal pyramid selling or religious activities on campus;

6. International students will be given warnings, serious warnings or demerits if they insult, besmirch, falsely accuse, frame or threaten others, or infringe upon others’ rights of correspondence freedom.

Article 9 International students will be given following penalties if they violate Dormitory and Accommodation Requirements.

1. International students who do not return to dorm overnight without permission of CIS will be given the penalty of warning and above in light of the seriousness of the case; international students who return to dorm late and refuse to mend their way after repeated education will be given the penalty of warning and above .

2. International students will be given a warning or a serious warning in light of the seriousness of the case if they let others outside the university stay in the dorm without permission from College of International Students. 

3. International students who are permitted to live off campus for some special reasons will be given a penalty of serious warning and above if they violate relevant regulations and bring bad influences to the university.

4. International students shall not smoke, light fire or burn things in the dorm. Cooking inside the room is forbidden. International students who violate the regulations and refuse to mend their way after repeated education will be given the penalty of warning and above .International student shall compensate for loss and will be given a penalty of serious warning or above in the light of the seriousness of the case if they cause fire due to negligence. 

5. International students will be given a penalty of warning and above in the light of the seriousness of the case if they violate the regulation of electricity management or use illegal electrical appliances. 

6. International students will be criticized and educated if they make noise, play music or musical instruments, hold a party and conduct other behaviors which disturb others’ study, life and rest in the dorm building. Students who refuse to correct despite admonition will be given penalties of warning and above in the light of the seriousness of the case, and CIS will require them to check out if they repeat the violation of the rule. 

7. International students will be given penalties of warning or above if they conduct behaviors violating Dormitory and Accommodation Requirements according to the seriousness of the case.

Article 10 International students will be given demerits or probations in the light of the seriousness of the cases if they conduct improper acts and severely violate the social morality in interpersonal communication.

Article 11 International students will be given the following penalties in the light of seriousness of the cases if they commit theft and fraudulence of national, collective and personal properties, but the case is not serious enough to constitute a crime:

1. A warning or a serious warning if the property value is below 500 CNY;

2. A Serious warning or a demerit if the property value is above 500 and below 1000 CNY;

3. A demerit or probation if the property value is above 1000 CNY;

4. A demerit or probation if the property value is below 1000 CNY but the students refuse to correct despite repeated admonition;

Article 12 International students will be given the following penalties in the light of seriousness of the cases if they violate the internet-using regulations in China, but the case is not serious enough to constitute a crime:

1. Demerits or probations if they log on the illegal website , write or spread distortions or insults to others’ human dignity, write obscene or violent information and cause bad effect on the website;

2. Serious warning or demerits if they intentionally produce or spread destructive programs such as computer virus, and destroy the normal operations of the computer system;

3. Warnings or serious warnings if they steal others’ IP addresses or user accounts through internet and endanger the safety of the website.

Article 13 Apart from making the economic compensation including expenses for the victim’s medicine, care, essential nutrients, etc., international students will also be given the following penalties if they organize, plan or take part in the fights, but the case is not serious enough to constitute a crime:

1. A demerit for the organizer or the trouble causer of the fighting; a probation if the case is serious enough;

2. A warning or a serious warning for the student taking part in the fighting;

3. A demerit if the student intentionally provides equipment for the fighting.

Article 14 International students will be given a serious warning if they hide or carry tools that are controlled by Chinese public security authorities. International students will be given a penalty of demerit and above in the light of the seriousness of the case if their acts cause any consequences.

Article 15 International students will be given a demerit or probation in the light of the seriousness of the case if they take drugs.

Article 16 Motorbikes are prohibited on campus. International students will be given a penalty of warning or above in the light of the seriousness of the case if they ride the motorbikes on campus.

Article 17 International students will be given a warning or a serious warning if they swim in the river without permission.

Article 18 International students will be given the following penalties if their truancies of the semester reach a certain amount of class hours:

1. A warning if the truancy is up to 16 class hours;

2. A serious warning if the truancy is up to 24 class hours;

3. A demerit if the truancy is up to 32 class hours;

4. A probation if the truancy is up to 40 class hours;

5. An expulsion if the truancy is up to 50 class hours or the absence in the stipulated teaching activities without permission lasts for two successive weeks. 

6. An upper level of penalty will be given to the international students if they face another case of truancy again within one semester.

Article 19 International students will be given penalties if they violate the exam regulations according to the Regulations on Examination Discipline. 

Article 20 International students will be given demerits or probations if they plagiarize or copy others’ researches; if the case is serious enough, they will be expulsed from the university.

Article 21 International students will be given serious warnings or demerits if they counterfeit the certificates and cheat others, but the cases are not serious enough to constitute crimes.

Article 22 Cumulative penalty shall be given to International students who have received penalty within their study duration when they face a new penalty case .

Article 23 International students who are punished will be disqualified for the application of university scholarship and awards within one year.

Article 24 The probation for international students lasts for one year. The international students who get the probation should be reviewed regularly by CIS. The students can apply for a release on probation within one month after the probation expires. After the affiliated school and CIS evaluate the students’ performance and reports its decision to the International Students’ Affairs Committee for approval, the probation can be released. The students whose probations have lasted for more than 6 months but less than one year can be released in advance if they show obvious improvements during the probations according to the above procedure. The students who violate the rules again during the probations will be expulsed from the university.

Article 25 International students who are probated and are not released from probations before the graduation will be given the certificate of completion. When the probations expire, they can apply for the certificate of graduation if their employers certify their improvements and their qualification of graduation is verified by the affiliated school and CIS. The certificate of completion shall be withdrawn when the university issues the certificate of graduation. 

Article 26 International students who are expulsed from the university can get the study certificate from the university. They shall follow the leaving procedure according to the university regulations and leave for their home countries within 10 days since they receive the penalty decision letter. 

Article 27 Other offenses that are not listed in the regulation shall be handled according to similar regulations. 

Article 28 CIS shall record the penalty materials in international students’ archives honestly and completely and will report to the affiliated school.

Article 29 CIS is responsible for the interpretation of the regulations.
