Joint Statement for Eligible Foreign Graduates to Seek Employment in China by the Ministry of Education, the Ministry of Foreign Affairs, and the Ministry of Human Resources and Social Security

Ⅰ. Scope of applicants

Foreign graduates refer to foreign students who have graduated within one year with a master’s degree or above from Chinese or well-known foreign universities.

Ⅱ. Requirements

Foreign graduates working in China shall meet the following requirements:

1. At least 18 years old and have good health; 

2. Possess a non-criminal record;

3. Have the academic excellence with average scores no less than 80 out of 100 points or at least a Level B (Good) , and non-delinquent behavior record at school.

4. Have received relevant academic qualifications and degrees;

5. Have confirmed employing units. The position should match with the individual’s academic specialties. The salary should be no less than the average salary of locals. The specific salary standards can be determined by the provincial departments of human resources and social security according to the actual situation in employment market and the practical needs of talents introduction.

6. Have valid passports or replacement certificates.

Ⅲ. Procedures

The employment units which hire the eligible foreign graduates shall apply to the local human resources and social security departments or the administrative department of foreign experts, and provide the following documents:

1. Employee’s credential (CV);     

2. Employment offer letter (proof of expected salary included);

3. Reason of employment report( proof that the recruitment advertisement from the local public employment and talent service agencies have been published to domestic workers for over 30 days included);

4. Health certificate;

5. A non-criminal record;

6. Relevant academic qualifications and degrees;

7.Non-delinquent behavior record issued by the university (graduates from foreign universities excluded) and the transcript;

8. The full-faced photos taken in latest 6 months.

The department of human resources and social security or the administrative department of foreign experts is in charge of the approval of the documents. Qualified foreign graduates will be granted employment permit (or working permits, similarly hereinafter)and employment certificates (or working certificates, similarly hereinafter).

Qualified foreign graduates who graduate from foreign universities reserve the same right to be granted employment permit and shall possess a Z visa to enter China before applying for the work permit upon arrival.

Ⅳ. Others

1. The employment certificate will be valid for one year upon first arrival, and shall be extended for no more than five years when the employment is due and will be continued after completing certain procedures. The employment certificate shall not be extended provided that the income tax of  the foreign graduates is lower than that they should pay, or the salary the employment units provides is lower than the stipulated standard..

2. The foreign graduates working in China will be under a quota management which vary from province to region. The provincial departments of human resources and social security shall report to the Ministry of Human Resources and Social Security about the quantity demand of foreign workers before December 1st each year in accordance with the local enterprise’s demand and the actual employment situation. The Ministry of Human Resources and Social Security will stipulate the quotas for the state ,each province, region and city after a comprehensive study, declare and post to the public, while copying to the Ministry of Foreign Affairs, the Ministry of Education and the Ministry of Human Resource and Public Security for cooperative implementation.

3. This statement shall enter into force upon its printing and distribution.
